Terms and Conditions of Use

1. Website Operator and Scope

Culturae Heritage Services srls (hereinafter the "Company", "Operator" or "We"), with registered office at Via dei Banchi 6, 50123 Firenze, Italy, VAT No. IT07519170489, Tax Code 07519170489, REA FI-709102, share capital € 4.000 fully paid up, ATECO code 581900 (Other publishing activities, excluding software publishing), owns and operates the website hotairballoon.travel (hereinafter the "Website") and other websites with similar editorial purposes.

These Terms and Conditions of Use (hereinafter the "Terms") govern access to and use of the Website by any natural or legal person (hereinafter the "User").

Access to and use of the Website implies full acceptance of these Terms. If the User does not wish to accept them, they are invited not to use the Website.

2. Nature of the Website — Editorial Disclaimer

This Website is not the official website of any museum, monument, cultural institution, public entity, or any other third party. It does not speak for, and does not represent the intentions, wishes, or official positions of, the entities that own the cultural, tourist, or museum sites described in its content.

The Website is exclusively editorial and informational in nature. The Company operates as a digital publisher under ATECO code 581900 and is not:

  • a tour operator under Italian Legislative Decree 79/2011 (Tourism Code);
  • a travel agency or travel intermediary;
  • an organiser or seller of travel packages;
  • a provider of tourism services, guided tours, or experiences;
  • the official entity or the owner of the domain name of any cultural site described.

The Website publishes original editorial content (articles, guides, practical information) about cultural, tourist, and museum sites, and suggests tours, guided visits, and experiences provided by independent third-party partners, receiving a commission when a User is referred to them.

The Website does not constitute a journalistic publication, as it is not updated on a regular schedule. It therefore cannot be considered an editorial product pursuant to Italian Law No. 62 of 7 March 2001.

3. Editorial Content

All content on the Website (texts, articles, guides, practical information) is produced by the Website's editorial team, unless otherwise indicated. It is freely inspired by the cultural sites described and is published in the exercise of the right to freedom of expression and information enshrined in Article 21 of the Italian Constitution and Article 10 of the European Convention on Human Rights.

Content is purely informational and does not constitute a public offer, professional advice, a contractual commitment, or an investment invitation.

Part of the editorial content is produced with the support of automated translation and generative artificial intelligence tools, under human editorial supervision.

4. Tours and Experiences — Affiliate Model

The Website does not sell tours or experiences and does not process bookings or payments.

Where the Website presents a tour or an experience, it links to the website of an independent commercial partner. Depending on the content published, such partners may include: GetYourGuide, Viator (Tripadvisor Group), Tiqets, Civitatis, Headout.

In all such cases:

  • the purchase contract is entered into exclusively between the User and the third-party partner;
  • the Company is not a party to that contract and assumes no liability for bookings, payments, service delivery, cancellations, refunds, or complaints;
  • the Company does not collect, process, or store the User's payment data in any way (card numbers, bank details, security codes);
  • the invoice and the voucher for the purchased tour are issued directly by the partner;
  • for any complaint, refund request, or cancellation relating to a purchased tour, the User must contact the partner directly;
  • the processing of the User's personal data on the partner's website is governed by that partner's privacy policy;
  • the Company receives a commission from the partner for the referral.

Prices, availability, schedules, and conditions shown on the Website are drawn from the partners' systems and may not be up to date in real time. The binding information is the one shown on the partner's website at the time of booking.

5. Ranking of Results and Offers

Where the Website presents search results, rankings, or lists of tours and experiences from more than one partner, the main parameters determining the order of presentation may include:

  • relevance to the content of the page being viewed;
  • availability of the experience on the requested dates;
  • ratings and number of reviews reported by the partner;
  • commercial relevance, meaning the affiliate commission payable to the Company.

Commercial relevance is one of the ordering criteria: a higher position may correspond to a higher commission for the Company. No partner pays for a specific placement outside of this criterion.

This information is provided pursuant to Article 22, paragraph 4-bis, of the Italian Consumer Code (Legislative Decree 206/2005).

6. Newsletter

The User may subscribe to the Website's newsletter to receive updates, editorial content, and information about tours and experiences.

Subscription is voluntary and occurs exclusively with prior express consent. The User may withdraw consent and unsubscribe at any time through the unsubscribe link included in every message, or by writing to the address in Section 1. Messages are sent through Amazon SES (region eu-west-1, Ireland).

7. Ratings and Reviews

Where the Website shows ratings or reviews of tours and experiences, these originate from the partner platforms (GetYourGuide, Viator, Tiqets, Civitatis, Headout), which collect them from users who have booked through their systems, and are reproduced as provided by the source platform with an indication of its origin. The Company does not alter the content or the score of third-party reviews.

The Website does not collect reviews directly from its own Users.

8. Intellectual Property and Copyright

8.1 Original content

All original content on the Website (texts, articles, guides, layout, graphics, source code) is owned by Culturae Heritage Services srls and is protected by Italian and European copyright law (Law 633/1941 as amended, Directive 2001/29/EC).

Reproduction, distribution, communication to the public, or any other use, even partial, of the Website's original content without the prior written consent of the owner is prohibited, except as permitted by law (for example the right of quotation and educational use).

8.2 Third-party content

The Website also uses content owned by third parties, including:

  • images licensed from stock photo agencies;
  • images and content supplied by commercial partners;
  • images in the public domain or otherwise freely usable;
  • names, logos, and trademarks belonging to their respective owners.

All third-party content remains the property of its respective owners and is used in accordance with the applicable licences. Where possible, each item of content not free of rights is accompanied by an indication of its source.

8.3 Trademarks and trade names

The names of museums, monuments, institutions, tour operators, and any other trademarks mentioned on the Website belong to their respective owners. Their use on the Website is descriptive and informational only and does not imply any affiliation, endorsement, or commercial relationship with the trademark owners, unless expressly stated.

9. Limitation of Liability

The Company endeavours to publish accurate and up-to-date information. However:

  • information on the Website is provided for informational purposes only and does not constitute a public offer, professional advice, or a contractual commitment;
  • the Company does not guarantee the accuracy, completeness, timeliness, or fitness for a particular purpose of the published content, in particular as regards opening hours, ticket prices, availability, and conditions of tours and experiences, which are subject to change by third parties;
  • the Company is not liable for any direct or indirect damages, whether pecuniary or non-pecuniary, arising from the use of information on the Website, from reliance thereon, or from the inability to access the Website;
  • the Company is not liable for the content, policies, practices, or services of third-party websites accessible through links on the Website;
  • the Company is not liable for any matter relating to bookings, payments, service delivery, cancellations, or refunds, all of which are handled entirely by third-party partners;
  • any inaccuracies, missing sources, errors, or omissions in the content are to be considered good-faith oversights.

Nothing in this Section limits liability that cannot be excluded under mandatory law, including liability for wilful misconduct or gross negligence and the rights granted to consumers by mandatory provisions.

10. Reporting Errors and Rights Infringements

If the User identifies inaccuracies, errors, inappropriate content, or content that infringes their rights — including copyright in an image or text — they are invited to report it promptly to [email protected], indicating the page concerned and the grounds for the report.

Images published on the Website have been obtained after verifying that they were licensed, in the public domain, or otherwise freely usable. Where a report is well founded, the Company undertakes to verify it and to remove or correct the content in question promptly.

11. Links to Third-Party Websites

The Website contains links to third-party websites (commercial partners, social networks, service providers). Such links are provided for the User's information and convenience. The Company has no control over the content, privacy policies, or practices of those sites and disclaims all responsibility in this regard.

12. Service Availability

The Company reserves the right to modify, suspend, or discontinue the Website or any part of its services at any time, without prior notice and without any obligation to compensate.

13. Amendments to the Terms

The Company reserves the right to amend these Terms at any time. Each version carries a version number and an entry-into-force date, shown at the top of this page. Amendments take effect from the date of publication on the Website. Continued use of the Website after publication constitutes acceptance of the new Terms.

14. Governing Law and Jurisdiction

These Terms are governed by Italian law.

For any dispute relating to the interpretation or performance of these Terms, the Court of Florence shall have exclusive jurisdiction, unless otherwise provided by mandatory consumer protection provisions. In the latter case, jurisdiction lies with the court of the consumer's place of residence or domicile if located in Italy, or is determined under Regulation (EU) No. 1215/2012 for consumers resident in other EU Member States.

Out-of-court dispute resolution. The European Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 pursuant to Regulation (EU) 2024/3228, which repealed Regulation (EU) No. 524/2013. Consumers resident in the European Union who wish to pursue an out-of-court settlement may turn to the alternative dispute resolution (ADR) bodies competent in their own country, or to the European Consumer Centres Network (ECC-Net) for cross-border disputes.
